Oh lord, Dusty, how on earth did you stay awake? That we’ve come to this: legal wrangling about the Gender Reassignment Act V the Equality Act? I felt like Alice in wonderland & was tempted to shout at their honours, “off with their heads” about the Scottish minister’s ridiculous attempt to get Self-ID in law. Thanks for your marathon efforts to bring this insanity to us. Will share.

Hi Liz

You're welcome.

I impressed myself with my ability to stay awake!! However I think it is important to clarify whether I was awake with a certificate or without one😃

Being in the overflow court was I think helpful to us Terfs because we could roar with laughter at certain moments😄

I found this comment very interesting - "If someone has declared intention to live as the opposite sex it would be strange if they could rely on provisions regarding their previous sex."

I have already heard of a situation, in the USA, where a woman with endometriosis wasn't covered by her medical insurance for treatment, because the women 'identifies' as a man. I daresay that this is wider spread than just the one situation I've read about. My feelings about whether or not I feel sorry for such women are mixed, and the same would apply to men who say they're women, although, because these men cause a whole heap more problems for women with their cross-dressing fetish, I lean more towards the 'not'.

Hi Katrina

One of the most entertaining’ discussions was about the so called ‘pregnant man’ ie a larping woman with a GRC who SM say is a man under the EQA. On the face of it a ‘pregnant man’ could not avail ‘himself’ of the pregnancy rights contained in the EQA!! Ms Crawford for SM got very lost in the woods with these nonsensical anomalies

Just shows the chaos which can unfold when you base the law on a lie. I expect there’ll be many more unforeseen pitfalls if this goes through.

Yes indeed TT.

I think my favourite was Ms Crawford's suggestion that a lesbian group could perhaps exclude a larping man with a GRC if they said that being a lesbian was a philosophical belief. That got the biggest and most sustained laugh of the day😂

Thanks Dusty, brilliant work. Seeing as I’m a legal idiot, I’m happy to go with your conclusions and it’s great that you feel more positive. It’s going to be such an anxious wait though, this really is huge. If the ability to change sex with a piece of paper becomes law in all circumstances, then we really will be in Alice in Wonderland land 😵‍💫as Liz says. Glad you could enjoy a laugh. Let’s hope the judges were joining in but silently. 😁

You're welcome, TT.

I appreciate that even my attempts to hone it down leave it substantially as legal gobbledygook. I may and try a really boiled down and short version.

It certainly is huge! The Scottish Ministers' barrister! Talk about painted into a corner!

I have certainly gone above and beyond the call of duty - the trains back to the Midlands are all being cancelled so I have booked in for another night in London!

After trying 7 hotels all of which were fully booked I thought I might end up in the park ( my wife was also at home desperately ringing around hotels). They were all full of people fleeing London Euston or not bothering to try and get home in the first place.I got in the 8th hotel I tried! The room is not en suite but I didn't care by that stage! The tribulations of the citizen journalist!!

Bloody hell Dusty , you’re quick off the mark ! Thank you for this

I admit I understood about one word in ten

It comes as no surprise that the rep for Scottish ministers had no clue , she’d probably been fed a pack of lies

I remember one case ( not the particulars but it may have been against salmond ) where scotgov were advised by the KC - roddy Dunlop I believe - not to go ahead with it as they would lose , guess what ………

I could’ve given them better advice for the price of a Greggs sausage roll , my services don’t come cheap you now !

Right I’ve doled out my wisdom , I’m off to watch pandas 🐼

I think you were in good company, Petal. A very well known Terf ( I won't embarrass her by naming her) was in front of me in Court Room 2 and she spent a lot of time looking at her phone so I would presume the legal arguments were often losing her.

It still beggars belief that it has gone to the Supreme Court to state that a man can’t become a woman . How are us mere plebs expected to understand when the top lawyers are tying themselves in knots

Hi Petal

Let’s hope the Justices go for what Mr O’Neill for FWS described as the ‘common sense solution’. His final speech ended on a high: ‘Women’s Rights are human rights ‘

Fingers crossed.

WOS has just released a piece containing lots of tweets regarding the case, many of them from lawyers who are equally bemused
