A Perth man has been fired from his high-paying job after refusing to apologise in writing for calling a non-binary colleague ‘he’ instead of ‘they’, in what workplace lawyers described as new legal territory for Australia.
The incident unfolded during a leadership training course in February when the older worker introduced his younger colleague to the room as ‘he.’
Another staff member immediately corrected him.
The colleague, a biological male who identifies as neither male nor female, had previously stated their preference to be called ‘they’ and wore a pronoun badge to avoid confusion, according to The West Australian. Dusty- to cause confusion more like!!
The man, 63, apologised on the spot, and the pair appeared to get along for the remainder of the day, even partnering in role-play exercises.
But hhis manager informed him a formal complaint had been lodged and that he would need to issue a written apology.
He refused, arguing that nobody could be compelled to call a colleague ‘they’.
At a Fair Work Commission (FWC) hearing, he argued that if one person had the arbitrary right to use a particular pronoun, then another person had the right not to.
He ultimately reached a confidential settlement with his former employer.

Australia’s online safety chief, Julie Inman Grant, has again been told by a federal tribunal that she cannot avoid legal review by using informal methods to contact tech companies instead of issuing a formal takedown notice under the Online Safety Act.
The Administrative Review Tribunal (ART) said this is the third time eSafety has failed in such an attempt, but the first time a complaint has centred on an online comment by the Commissioner herself.
The case involved the Free Speech Union (FSU) of Australia and a December 2024 interview with Inman Grant published on the Council of Foreign Relations website.
In it, she was quoted as saying, “There are front groups; one is called Free Speech Union of Australia, and they’ve run a campaign to increase the number of FOIs (Freedom of Information Requests) by 3,000 percent.”
FSU Director Reuben Kirkham complained to the Office of eSafety, alleging that her statements were false, damaging, and targeted him.
“The eSafety Commissioner herself has been raising conspiracy theories about myself,” he wrote.
“The material raises a conspiracy theory that the Free Speech Union is a ‘front group’ for X and Elon Musk and that we conducted a ‘campaign to increase the number of FOIs by 3,000 per cent.’
However, the Office of eSafety rejected his complaint, saying the material did not target a particular Australian adult and therefore did not meet the criteria for formal removal action.
When Kirkham requested a formal statement of reasons, Inman Grant refused, arguing no “reviewable decision” had been made, describing her actions instead as a “non-giving of a notice.”
Inman Grant has previously argued that actions short of a formal takedown notice are outside Tribunal oversight—an argument she has now lost three times.
In a previous case, she used an informal “back channel” to ask X to geo-block a post in Australia.
During that matter, the eSafety Commission admitted it sends “a few hundred” informal alerts to service providers annually, compared with just three or four formal removal notices in the past year.
In this latest decision, Tribunal Deputy President Peter Britten-Jones said it did not matter if the Commissioner subjectively believed she was not refusing a removal notice.
What mattered, he said, was that she made an assessment, reached a conclusion, and notified the outcome—actions that constitute a reviewable decision.
Following the ruling, Kirkham said many people who deal with the eSafety Commissioner are “vulnerable individuals” facing serious online abuse, including those subject to indecent image exposure, doxxing, stalking, and other severe forms of cyberabuse.
“Today’s decision shows [her] office has once again seriously misunderstood their duties towards the general public.
“Worst of all, it’s the taxpayer who has yet again footed the bill for the Commissioner’s lack of understanding, with a Senior Counsel engaged at great expense.”

The most radical restrictions on the rights of Australian women in more than a decade – and the most profound changes to the legal definition of ‘men’ and ‘women’ – have been proposed in the Federal Court this week.
It’s hardly surprising that the landmark Tickle v Giggle battle for female-only spaces has caught the attention of the rest of the world, including author and women’s rights crusader J.K. Rowling, who this week alerted her 14 million followers on social media.
But if you read the Sydney Morning Herald or The Age, or watch or listen to the ABC, you’d never know it.
This week the full bench of the court hearing the appeal has been asked to rule not only that “sex” is non-binary, but that the distinction between men and women has all but disappeared. Lawyers for Equality Australia, which claims to represent gay and trans people, have proposed that sex is simply “a way of classifying people along a scale between a man at one end and a woman at the other”.
“As a matter of ordinary meaning, the statute is agnostic as to where persons are plotted along that scale,” barrister Ruth Higgins added unhelpfully.
No matter what your view of its merits, the idea that sex is a continuum between men and women is a radical interpretation even of the confused 2013 amendments to the Sex Discrimination Act. But the proposition was apparently supported – and certainly not challenged – by the Sex Discrimination Commissioner, who also insisted to the court that sex was non-binary, and that a trans woman – a biological man – cannot be excluded from a female-only space.
Apart from The Australian, the only other mainstream outlet to have reported on this week’s case was the Guardian, and to its credit, it covered it fairly.
The Federal Court understood the significance of the case and live-streamed it on YouTube, as it has for other major cases like the Ben Roberts-Smith and Bruce Lehrmann defamation trials. But from the rest of the media – thunderous silence. Not a peep.
Why have they shrunk from one of the most important legal cases of the year?
How many Australians silently support the right of women to have their own spaces but can’t risk losing their job or their friendship group for fear of being called a bigot or a TERF?
The absurdity of many of the propositions put by the Tickle camp may eventually prove self-defeating. But not if they escape scrutiny by a vigilant media.

In the public debate around gender medicine, one phrase often escapes scrutiny: “true trans.” It is used to describe an ostensibly rare category of people whose sense of belonging to the opposite sex is deemed so deep and immutable that medical transition becomes not only justified, but necessary. Yet this category, as reassuringly simple as it may appear, has no reliable diagnostic basis.
From Mid-Century Sexology to Modern Clinics
The concept emerged in mid-20th-century sexology. David Cauldwell first used “transsexual” in 1949, and Harry Benjamin’s The Transsexual Phenomenon (1966) drew a distinction between “true transsexuals” and other groups. These classifications were based largely on subjective criteria—persistence of desire, intensity of distress, and perceived “femininity” or “masculinity”—not on any biological marker or objective psychological test.
Cases such as Jan Morris, whose transition was chronicled in the 1970s, helped cement the public image of the “true transsexual” as a clearly identifiable phenomenon. In reality, this image was built on anecdote, clinical impression, and selective case histories, not replicable science.
Cass Review: Clinical Caution and Epistemic Limits
Dr Hilary Cass’s 2024 independent review of gender identity services for children and young people stands as the most comprehensive modern appraisal of this field in the UK. While she acknowledged that some individuals may benefit from medical transition, she also admitted there is no reliable way of knowing which patients might be in that category:
“We don’t know which young people are going to go on and have an enduring trans identity.”

JK Rowling calls for boycott on Marks & Spencer over transgender bra fitting row | The Sun

JK Rowling has called for a boycott on M&S if it continues to let transgender women into female changing rooms.
It came after it emerged a trans member of Marks & Spencer staff — a 6ft 2in biological male — asked a girl of 14 in the lingerie section if she needed help with a bra fitting.
The girl’s mum, who does not want to be named, called the approach “completely inappropriate” and said her daughter recoiled in horror.
She added that the teen was visibly upset and “freaked out”.
M&S apologised for the incident but has made no commitment that trans staff or customers would be told to stay out of female changing rooms.
Rowling wrote on X: “If stores like M&S continue to flout the Supreme Court ruling on women-only spaces, prioritising the wishes of men who want to undress near, or help fit bras on, teenage girls, a boycott seems appropriate.”

Thanks to an excellent suggestion from Tenaciously Terfin, we have paused Endpieces for the time being and we are giving Tenaciously and Liz a well earned rest from their hard work. So , since 07 July, we have been running Terf Island Discs.
